Toby Women: OK, well, unless girlfriend is 'executor' of his estate, she cannot sell you this guy's car. If she never titled it in her own name, it's not hers to sell. You have NO WAY of knowing if the car is REALLY paid off or not - it very well could be repo'd. And if he never signed a title over to her, then legally, his heir owns the car - which is most likely his mother, if he was! n't married. DO NOT try to buy this car. You'll probably NEVER be able to register it. She can't sell you MY car, and she can't sell you HIS car, either, and if the title isn't in her name, it's not HER car.To buy a car from a deceased person, the executor of the estate attaches the legal, notarized paper showing that they ARE the executor, to the title, and then sign the back of the title and have it notarized, as executor, over to you. Danyell Rowback: Stay away from that deal. She can't legally sell a car that she doesn't own. "He gave it to her" means nothing if she doesn't actually have clear title in her name.
